一、简介

本最终用户许可协议（"本协议"）适用于您对由天津朱印船电子商务有限公司（"我们"）开发和提供的移动应用程序"日语闪卡汪"（"本应用"）的使用。您承认本协议仅在您与我们之间成立，而非与 Apple 公司之间成立，Apple 对本应用不承担任何责任。

二、服务内容

本应用提供互动式日语词汇学习工具，包括拍照识别物体日语单词、闪卡复习等功能。
免费用户每日可识别图片的次数有限；订阅用户可不限次数使用图像识别服务，并可享受额外的高级功能。
免费用户可通过观看应用内广告获得更多识别次数；订阅用户使用过程无广告。

三、订阅与价格

本应用提供按月与按年计费的自动续订订阅服务：
  • 月度订阅：¥28 元人民币
  • 年度订阅：¥198 元人民币
订阅费用将在您确认购买后由您的 Apple ID 账户扣除。若您未在当前订阅周期结束前至少 24 小时取消订阅，系统将自动续订。
您可通过 Apple ID 设置管理或取消订阅。

四、取消与退款

您可以随时通过 Apple ID 账户取消订阅。请注意，我们不提供未使用订阅期的退款，所有计费与退款事务由 Apple 平台处理。

五、用户行为规范

您不得以滥用、欺骗或规避目的使用本应用，例如：大量上传重复图片、反复注册账号、与他人共享付费订阅权限等。一经发现，我们有权暂停或终止您的账号使用权限。

六、隐私政策

您使用本应用受《隐私政策》约束，隐私政策说明了我们如何收集、使用、存储与保护您的个人信息。

七、免责声明与保证条款

本应用按"现状"提供，不附带任何明示或暗示的担保。我们不保证应用始终可用或完全无误，对因使用或无法使用应用导致的任何直接或间接损失，我们概不负责。
如应用未能达到适用的保证要求，您可联系 Apple 申请退款。在适用法律允许范围内，Apple 不承担除退款外的任何责任。

八、产品责任与法律合规

我们对与本应用有关的所有索赔承担全部责任，包括但不限于：
  • 产品责任索赔
  • 应用未符合法律法规的主张
  • 违反消费者保护、隐私保护或相关立法的责任，尤其在涉及 HealthKit 或 HomeKit 框架使用时
您确认不会将本应用用于美国政府禁运国家或被认定为"支持恐怖主义"的国家/地区，亦不会作为美国政府限制交易对象名单上的个人使用本应用。

九、知识产权声明

如第三方提出本应用或用户使用本应用侵犯其知识产权的主张，我们将独立负责处理该类索赔，包括但不限于调查、辩护、和解与赔偿，Apple 不承担相关责任。

十、第三方条款的遵守

您同意，在使用本应用的同时，需遵守所有适用的第三方协议。例如：若您的使用行为涉及 VoIP 功能，您应确保不会违反您的电信服务提供商的使用条款。

十一、Apple 为第三方受益人

您确认并同意 Apple 及其子公司为本协议的第三方受益人。用户接受本协议即视为授权 Apple 有权以第三方身份强制执行本协议的相关条款。

Japanese Flashcard Wang - Terms of Use

1. Introduction

This End User License Agreement ("Agreement") applies to your use of the mobile application "Japanese Flashcard Wang" ("the App") developed and provided by Tianjin Shuinchuan E-Commerce Co., Ltd. ("we"). You acknowledge that this Agreement is concluded between you and us, not with Apple Inc., and Apple is not responsible for the App.

2. Services Provided

The App provides interactive Japanese vocabulary learning tools, including photo recognition of Japanese words for objects, flashcard reviews, and other features.
Free users have limited daily image recognition attempts; subscription users can use image recognition services unlimited and enjoy additional premium features.
Free users can earn more recognition attempts by watching in-app advertisements; subscription users enjoy ad-free experience.

3. Subscriptions and Pricing

The App offers auto-renewable subscription services billed monthly and yearly:
  • Monthly Subscription: ¥28 CNY
  • Annual Subscription: ¥198 CNY
Subscription fees will be charged to your Apple ID account after purchase confirmation. The system will automatically renew unless you cancel at least 24 hours before the end of the current subscription period.
You can manage or cancel subscriptions through Apple ID settings.

4. Cancellation and Refunds

You can cancel your subscription anytime through your Apple ID account. Please note that we do not provide refunds for unused subscription periods, and all billing and refund matters are handled by Apple.

5. User Conduct

You may not use the App for abusive, deceptive, or circumventing purposes, such as: uploading large amounts of duplicate images, repeatedly registering accounts, sharing paid subscription privileges with others, etc. Upon discovery, we reserve the right to suspend or terminate your account access.

6. Privacy Policy

Your use of the App is governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal information.

7. Disclaimer and Warranty Terms

The App is provided "as is" without any express or implied warranties. We do not guarantee that the App will always be available or completely error-free, and we are not responsible for any direct or indirect losses caused by using or inability to use the App.
If the App fails to meet applicable warranty requirements, you may contact Apple for a refund. To the extent permitted by applicable law, Apple assumes no liability other than refunds.

8. Product Liability and Legal Compliance

We assume full responsibility for all claims related to the App, including but not limited to:
  • Product liability claims
  • Claims that the App does not comply with laws and regulations
  • Liability for violations of consumer protection, privacy protection, or related legislation, especially when involving HealthKit or HomeKit framework usage
You confirm that you will not use the App in countries embargoed by the US government or designated as "supporting terrorism", nor use the App as an individual on the US government's restricted trading list.

9. Intellectual Property Statement

If a third party claims that the App or user's use of the App infringes their intellectual property rights, we will independently handle such claims, including but not limited to investigation, defense, settlement, and compensation. Apple assumes no related responsibility.

10. Compliance with Third-Party Terms

You agree to comply with all applicable third-party agreements while using the App. For example: if your usage involves VoIP functionality, you should ensure you do not violate your telecommunications service provider's terms of use.

11. Apple as Third-Party Beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this Agreement. User acceptance of this Agreement is deemed to authorize Apple to enforce relevant terms of this Agreement as a third party.

この最終利用者許諾契約（「本契約」）は、天津朱印船電子商務有限公司（「当社」）が開発・提供するモバイルアプリケーション「日本語フラッシュカード汪」（「本アプリ」）のご利用に適用されます。お客様は、本契約が当社とお客様の間で成立し、Apple Inc.との間ではないこと、およびAppleが本アプリについて責任を負わないことを承認します。

二、サービス内容

本アプリは、写真撮影による物体の日本語単語認識、フラッシュカード復習などの機能を含む、インタラクティブな日本語語彙学習ツールを提供します。
無料ユーザーは1日あたりの画像認識回数が制限されています。有料会員ユーザーは画像認識サービスを無制限で利用でき、追加のプレミアム機能をお楽しみいただけます。
無料ユーザーはアプリ内広告を視聴することで、より多くの認識回数を獲得できます。有料会員ユーザーは広告なしでご利用いただけます。

三、有料会員と価格

本アプリは月額および年額の自動更新有料会員サービスを提供しています：
  • 月額有料会員：¥28 CNY
  • 年額有料会員：¥198 CNY
有料会員料金は、ご購入確認後にApple IDアカウントから請求されます。現在の有料会員期間終了の少なくとも24時間前にキャンセルしない限り、システムは自動的に更新されます。
Apple ID設定で有料会員の管理またはキャンセルができます。

四、キャンセルと返金

Apple IDアカウントからいつでも有料会員をキャンセルできます。未使用の有料会員期間に対する返金は提供されず、すべての請求および返金業務はAppleプラットフォームで処理されることにご注意ください。

五、ユーザー行動規範

本アプリを悪用、詐欺、または回避目的で使用してはなりません。例：大量の重複画像のアップロード、アカウントの繰り返し登録、他者との有料会員権限の共有など。発見された場合、アカウントの使用権限を停止または終了する権利を留保します。

六、プライバシーポリシー

本アプリのご利用は「プライバシーポリシー」に従い、プライバシーポリシーでは当社がお客様の個人情報をどのように収集、使用、保存、保護するかを説明しています。

七、免責事項と保証条項

本アプリは「現状有姿」で提供され、明示または黙示の保証は一切ありません。アプリが常に利用可能であるか、完全にエラーがないかを保証せず、本アプリの使用または使用不能によって生じる直接的または間接的な損失について責任を負いません。
アプリが適用される保証要件を満たさない場合、Appleに返金を申請できます。適用法で許される範囲で、Appleは返金以外の責任を負いません。

八、製品責任と法的遵守

本アプリに関連するすべてのクレームについて、以下を含むがこれに限定されない完全な責任を負います：
  • 製品責任クレーム
  • アプリが法令に適合しないとの主張
  • 消費者保護、プライバシー保護、または関連法令の違反に対する責任、特にHealthKitまたはHomeKitフレームワークの使用に関わる場合
米国政府が禁輸している国または「テロ支援」と認定されている国・地域で本アプリを使用せず、米国政府の制限取引対象者リストに載っている個人として本アプリを使用しないことを確認します。

九、知的財産権に関する声明

第三者が本アプリまたはユーザーの本アプリ使用がその知的財産権を侵害するとの主張を提起した場合、調査、弁護、和解、補償を含むがこれに限定されない、このようなクレームの処理について独立して責任を負い、Appleは関連する責任を負いません。

十、第三者条項の遵守

本アプリの使用と同時に、適用されるすべての第三者契約を遵守することに同意します。例：ご使用がVoIP機能に関わる場合、電気通信サービスプロバイダーの利用規約に違反しないことを確認する必要があります。

十一、Appleが第三者受益者として

Appleおよびその子会社が本契約の第三者受益者であることを認識し、同意します。ユーザーが本契約を受け入れることは、Appleが第三者として本契約の関連条項を強制執行する権利を授権することとみなされます。
